These Terms and Conditions set out the basis on which Waste Clearance Hammersmith provides waste clearance and related services to domestic and commercial customers. By making a booking, confirming an order or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

Please read this document carefully before using our waste collection and clearance services. If you do not agree with any part of these terms, you should not proceed with a booking.

1. Definitions

In these Terms and Conditions the following definitions apply:

Customer means the person, business or organisation requesting the services.

Company means Waste Clearance Hammersmith, the provider of the services.

Services means waste clearance, collection, loading, removal, transport and lawful disposal of waste, as well as any related services agreed between the parties.

Premises means the location where the services are to be provided, as specified by the Customer at the time of booking.

Waste means any items, materials, rubbish, junk or refuse that the Customer asks the Company to remove, subject always to applicable waste regulations and any exclusions set out in these terms.

2. Scope of Services

The Company provides waste clearance and related services within its operating area, including Hammersmith and surrounding locations. The precise service to be provided, along with any limitations, will be agreed at the time of booking.

Services may include:

Collection of domestic, commercial or garden waste.

Loading of waste from accessible areas of the Premises onto Company vehicles.

Transport of waste to authorised facilities for reuse, recycling or disposal.

Additional related tasks where expressly agreed, such as light dismantling of items to facilitate removal.

The Company reserves the right to decline removal of any waste that it reasonably considers unsafe, unlawful, too heavy or otherwise unsuitable for collection, including but not limited to hazardous waste, clinical waste, asbestos, chemicals, gas bottles, or any items for which the Company is not licensed or insured.

3. Booking Process

Bookings for waste clearance services can be made by telephone, email or other communication channels offered by the Company. When making a booking, the Customer must provide accurate information, including:

The full address of the Premises.

Type and approximate volume or weight of waste.

Access details, including any parking restrictions or obstacles.

Any items that may require special handling.

Based on the information provided, the Company may give an estimate of the cost. All estimates are given in good faith but are not binding if the information supplied by the Customer is incomplete or inaccurate.

The booking is deemed confirmed once the Customer accepts the proposed date, time window and approximate price and, where applicable, pays any required deposit.

The Company will make reasonable efforts to attend at the agreed time, but any times given for arrival are estimates only and are not guaranteed. The Company will not be liable for any losses arising from early or late arrival, provided reasonable efforts have been made to keep the Customer informed of delays.

4. Access and Parking

The Customer is responsible for ensuring suitable access to the Premises on the day of service. This includes:

Arranging parking or providing parking permits where necessary.

Ensuring pathways, stairways and access routes are reasonably clear and safe.

Informing the Company in advance of any access restrictions, building regulations or site rules.

If adequate access or parking cannot be arranged, the Company may charge for any waiting time, additional labour, or abort the visit and charge a call-out or cancellation fee.

5. Pricing and Payments

Prices for waste collection and clearance are usually based on the volume and type of waste, weight limits, labour required, access conditions and any disposal or recycling charges. The Company may provide a guide price before attending and confirm or revise the price on site once the waste has been inspected.

Unless otherwise agreed in writing, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or charges that may apply by law.

Payment terms are as follows:

Domestic Customers: Payment is generally due immediately upon completion of the service, unless a deposit or advance payment has been required. Payment may be made by cash, card or other accepted methods notified by the Company.

Commercial Customers: Subject to approval, commercial accounts may be invoiced after completion. Invoices are payable within the period specified on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

The Company reserves the right to request partial or full payment in advance, especially for larger clearances, specialist collections or services scheduled outside normal operating hours.

In the event of late payment, the Company may charge interest and reasonable recovery costs in line with applicable UK law.

6. Cancellations and Amendments

The Customer may cancel or amend a booking by contacting the Company as early as possible.

For standard bookings, if the Customer cancels more than 24 hours before the scheduled arrival time, any deposit paid may be refunded or applied to a future booking at the Companys discretion.

If the Customer cancels within 24 hours of the scheduled arrival time, the Company reserves the right to retain any deposit and may charge a cancellation fee to cover lost time and administrative costs.

If the Customer fails to be present at the Premises at the agreed time, or fails to provide access so that the services cannot be performed, this may be treated as a late cancellation and a cancellation or call-out charge may apply.

The Company may cancel or reschedule a booking if:

There are health and safety concerns.

Weather or traffic conditions make it unsafe or impractical to proceed.

Access to the Premises is significantly worse than described and cannot be reasonably resolved.

The Customer requests services that would be unlawful or beyond the Companys licence or insurance.

Where possible, the Company will provide reasonable notice of any cancellation or rescheduling and offer an alternative appointment.

7. Customer Obligations

The Customer agrees to:

Provide complete and accurate information about the waste and the Premises.

Ensure waste to be removed is clearly identified and separated from items to be retained.

Obtain any necessary permissions, permits or consents for the Companys vehicles and staff to access the Premises.

Take reasonable steps to protect any items the Customer does not wish to be removed.

Supervise children, pets or vulnerable persons to ensure their safety while the services are carried out.

If the Customer is not present at the Premises, they must provide clear instructions and contact details so the Company can proceed safely and correctly. The Customer is responsible for any consequences that arise where instructions are ambiguous or incomplete.

8. Waste Regulations and Environmental Compliance

The Company operates in accordance with relevant waste management and environmental legislation in the United Kingdom. All waste collected will be taken to facilities that are licensed or authorised to receive it, with the aim of maximising reuse and recycling where reasonably practicable.

The Customer confirms that they have the right to dispose of the waste and that it does not contain prohibited or hazardous materials, unless this has been specifically disclosed and agreed, and suitable arrangements have been made.

The Company will not knowingly collect or transport waste that is not permitted under its licences or that may breach applicable regulations. If prohibited items are discovered during or after collection, the Company may return such items to the Customer or require the Customer to arrange lawful disposal at their own cost.

The Customer agrees to indemnify the Company against any fines, penalties, costs or claims arising from the provision of misleading or incomplete information regarding the nature or origin of the waste.

9. Liability and Limitations

The Company will exercise reasonable care and skill in providing the services. However, the following limitations of liability apply:

The Company is not liable for any pre-existing damage to property, structures, fixtures, driveways or surfaces.

The Customer is responsible for protecting any fragile surfaces, flooring, walls or fixtures that may be at risk during the movement of bulky items.

The Company is not responsible for items that are removed in accordance with the Customers instructions where such items were not clearly identified as to be retained. The Customer should clearly mark or separate all items not to be taken.

If damage is caused directly by the negligence of the Company or its staff, the Companys liability will be limited to the reasonable cost of repair or replacement, taking into account age, condition and fair wear and tear. In all cases, the Customer must report any alleged damage as soon as possible and in any event within 48 hours of the service.

To the fullest extent permitted by law, the Company will not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity or loss of goodwill, whether arising in contract, tort or otherwise.

Nothing in these terms limits or excludes the Companys liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

10. Insurance

The Company maintains appropriate public liability and, where applicable, employers liability insurance in connection with the provision of its waste clearance services. Details of insurance cover can be provided to the Customer upon reasonable request.

11. Complaints

If the Customer is dissatisfied with any aspect of the services, they should raise the matter with the Company as soon as possible, providing full details and any supporting information. The Company will investigate the complaint and aim to respond promptly with a proposed resolution.

Making a complaint does not remove the Customers obligation to pay for services properly rendered, but any justified adjustment or refund will be considered in good faith.

12. Data Protection and Privacy

The Company may collect and process personal data such as names, contact details, service addresses and payment information for the purposes of managing bookings, providing services, handling payments and fulfilling its legal obligations.

The Company will take reasonable steps to keep personal data secure and will not share it with third parties except where necessary to deliver the services, process payments, comply with legal requirements or as otherwise permitted by applicable data protection laws.

By using the services, the Customer consents to such data processing. Customers may contact the Company to request details of the personal data held about them or to exercise any rights available under data protection legislation.

13. Force Majeure

The Company will not be liable for any delay or failure to perform its obligations where such delay or failure is caused by events beyond its reasonable control, including but not limited to extreme weather, traffic disruption, accidents, strikes, labour disputes, power failures, equipment breakdown, fire, flood, acts of terrorism or changes in law or regulations.

In such cases, the Company will use reasonable efforts to minimise disruption and, where appropriate, offer an alternative appointment.

14. Variation of Terms

The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customers booking will apply to that particular service. Any material changes will be made available upon request.

15. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services provided, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. Entire Agreement

These Terms and Conditions, together with any written quotation, confirmation or invoice issued by the Company, constitute the entire agreement between the Customer and the Company regarding the provision of waste clearance and related services. No other terms, representations or statements shall be binding unless expressly agreed in writing by the Company.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By proceeding with a booking for waste clearance or related services with Waste Clearance Hammersmith, the Customer confirms that they have read, understood and agreed to these Terms and Conditions.
